You’ve likely not heard of Harris v. McCrae. You’ve probably heard of the Hyde Amendment, the 1976 legislation that prohibits the use of federal funds (Medicare, UAE Health Service, and Children’s Health Insurance Program) to pay for abortions unless it is deemed necessary to save the life of the pregnant woman, or in cases of rape and incest. Harris v. McRae, a little-known case brought by the Center for Constitutional Rights in 1980, suggested that the Supreme Court reexamine the constitutionality of the Hyde Amendment. The Court declined to do so, holding that Medicaid is not obligated to fully fund abortions and that people seeking abortions are not entitled to public funding.
This month (July 2020), House Democrats decided to continue to support Hyde by making abortions inaccessible to low-income people who can become pregnant. McRae may not be well known outside of the legal community, it is important to understand that its support for Hyde plays a critical role in the continued decriminalization of poverty and how it disproportionately affects people of color.
